1. Introduction
Welcome to Eyaana. By accessing or using our services, you agree to be bound by these Terms and Conditions (“Terms”) and to comply with all applicable laws and regulations of the United Arab Emirates. If you do not agree to these Terms or fail to comply with the applicable laws and regulations of the United Arab Emirates, you must not use our services.
2. Definitions
- "Eyaana" refers to the AI-powered Marketing , Sales & customer support platform owned and operated by Royex Technologies LLC a company registered in the United Arab Emirates.
- "User" refers to the AI-powered Marketing , Sales & customer support platform owned and operated by Royex Technologies LLC a company registered in the United Arab Emirates.
- "Services" refers to all features, functionalities, applications, and services provided by Eyaana.
- "Content" refers to any text, images, data, or other material provided by Eyaana or its users.
3. Eligibility
By using Eyaana, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using Eyaana on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
4. User Responsibilities
Users are responsible for maintaining the confidentiality of their account information, including passwords. Users must not use Eyaana for any unlawful or prohibited purposes. Any misuse of the platform may result in termination of access.
5. Intellectual Property Rights
All content, software, and technology used in the operation of Eyaana are the exclusive property of Royex Technologies LLC or its licensors. Users are granted a limited, non-exclusive, non-transferable license to use the services for personal or business purposes, subject to these Terms. All intellectual property rights are protected under the applicable laws of the United Arab Emirates, including but not limited to copyright, trademark, and trade secret laws.
6. Account Registration
To access certain features of Eyaana, users must create an account. Users agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
7. Payment Terms
If you purchase any paid services from Eyaana, you agree to pay all applicable fees. Eyaana reserves the right to change its fees at any time. Any changes to fees will be communicated to users through changes in Eyaan.com Website or the eyaana dashboard.
8. Privacy Policy
Eyaana complies with the UAE Federal Decree Law No. 45 of 2021 on the Protection of Personal Data. Users acknowledge and agree that their data will be handled in accordance with UAE data protection regulations.
9. User-Generated Content
Users may submit content, such as feedback, suggestions, or other materials ("User-Generated Content"). By submitting User-Generated Content, you grant Eyaana a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display such content in connection with the operation of the services.
10. Prohibited Activities
Users agree not to engage in any of the following activities:
- Posting or transmitting any content that is unlawful, harmful, threatening, abusive, or defamatory.
- Using the platform to violate the rights of others, including intellectual property rights.
- Engaging in any activity that could harm or disrupt the operation of Eyaana or its services.
- Attempting to gain unauthorized access to Eyaana's systems or accounts.
- Users must not post any content that violates the UAE Cybercrime Law, including but not limited to content that offends religion, promotes hate speech, or undermines public morals
11. Termination
Eyaana reserves the right to suspend or terminate access to the platform at any time, for any reason, including but not limited to violation of these Terms. Upon termination, users must cease all use of the services and delete any copies of the platform in their possession.
12. Disclaimers
Eyaana is provided "as is" without warranties of any kind, either express or implied. Eyaana does not guarantee that the services will be uninterrupted or error-free. Users use the platform at their own risk.
13. Limitation of Liability
In no event shall Eyaana, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the use of the services.
14. Indemnification
Users agree to indemnify and hold harmless Eyaana, its affiliates, and its licensors from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or in connection with their use of the services, violation of these Terms, or infringement of any rights of another party.
15. Governing Law
These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of United Arab Emirates, without regard to its conflict of law principles.
16 .Local Law Compliance
"Users agree to comply with all applicable laws and regulations of the United Arab Emirates while using Eyaana, including but not limited to laws related to e-commerce, cybersecurity, and consumer protection."
17. Refund Policy
All sales for paid services are final unless otherwise stated. Refunds, if applicable, will be processed in accordance with the terms set forth at the time of purchase and in compliance with UAE consumer protection laws. To request a refund, users must contact our support team at info@eyaana.com within 7 days of the transaction. Eyaana reserves the right to approve or deny refund requests at its sole discretion, subject to applicable laws in the United Arab Emirates.
18. Changes to Terms
Eyaana reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the platform. Continued use of the services after changes are posted constitutes acceptance of the revised Terms.
